FORT COLLINS TRACK CLUB
RELEASE OF LIABILITY AND AGREEMENT, AND MEDICAL RELEASE
The undersigned hereby agrees, warrants and covenants as follows:
1. The undersigned participant (or the undersigned parent or
guardian of a participant under the age of 18 years), on behalf of
such participant and such participant's personal representative and
heirs, fully releases, discharges and waives any claim, demand or
legal action that the participant and/or his parent or guardian may
have, now or in the future, against the Fort Collins Track Club, its
directors, officers, agents, employees, volunteers, or assistants
(collectively referred to as " the FCTC") which may arise out of (i)
any property damage to property owned by the participant or the
participant's parent or guardian, or (ii) any personal injury,
bodily injury, or death of participant while participating in the
Fort Collins Track Club program, including, but not limited to
practices, track meets, exhibitions, contests and any other
associated activities ("Claim"). ("Personal injury" means, injury,
other than bodily injury, including, but not limited to, injury
arising out of libel, slander, or defamation of character. "Bodily
injury" shall mean bodily injury, sickness, or disease.)
2. The participant (or the undersigned parent or guardian of a
participant under the age of 18 years), on behalf of such
participant and such participant's personal representative and
heirs, agrees to indemnify and hold harmless FCTC from any loss or
liability (including reasonable attorney's fees) on account of any
Claim. Further, as to any participant under the age of 18 years, the
undersigned parent or guardian of such participant also agrees to
indemnify and hold harmless the FCTC from any loss or liability
(including reasonable attorney's fees) on account of any Claim.
3. In the event of an injury to a participant who is under the age
of 18 years, the undersigned parent's or guardian's gives the FCTC
permission to administer first aid at their discretion and to seek
necessary medical treatment in the event that, after reasonable
effort, a parent or guardian of a participant cannot be reached.
The undersigned has fully read and understands this document and
signs the same willingly. The undersigned acknowledges that this
release and waiver is to be broadly interpreted so as to provide the
greatest release of liability and indemnity as is permitted by the
laws of the State of Colorado. If any portion of this document is
held invalid, the remaining portions shall continue in full force
and effect. The laws of the State of Colorado shall govern the
interpretation and enforcement of this document.
